Geradin Partners secures ACM clearance of Aramis project JV for EBN and Gasunie

Geradin Partners advised Energie Beheer Nederland (EBN) and Gasunie in obtaining merger clearance from the Netherlands Authority for Consumers and Markets (ACM) for the establishment of a joint venture in relation to the Aramis project. The Aramis project is a key infrastructure project for the development of carbon capture and storage (CCS) in the Netherlands. The joint venture will build and operate trunkline infrastructure for transporting captured CO₂ for permanent storage in depleted gas fields beneath the North Sea, unlocking storage capacity for hard-to-abate industry. The Aramis project is an important pillar the Netherlands’ efforts to meet its decarbonisation goals.

The ACM cleared the transaction on 4 February 2026, concluding that sufficient competition would remain on the relevant CCS-markets. Geradin Partners assisted the parties throughout the notification and review process before the ACM.

Homebuyers set to sue major UK housebuilders for breaches of competition law

Concerns over over-charging for new homes by UK housebuilders will be the subject of landmark litigation later this year.

Consumer champion and experienced class representative Mark McLaren, supported by a leading legal team, will file an opt-out competition damages claim on behalf of UK homebuyers who purchased new-build homes from seven of the country’s largest housebuilders, it was announced today.

The claim will allege that major UK housebuilders exchanged competitively sensitive information over a number of years—including details of achieved selling prices, incentives offered to buyers, and sales and reservation activity—which led to them charging higher prices for new-build homes. 

In 2025, the size of the UK residential construction market was estimated at about £88.6 billion, with new-builds accounting for over three-quarters of this market. Anti-competitive behaviour in a market of this size is liable to have a significant impact on all those buying a new-build home.

The planned claim follows an investigation by the Competition and Markets Authority (“CMA”) which  focused on suspected anti-competitive conduct by seven housebuilders in relation to the sale of new-build homes across Great Britain. The CMA accepted binding commitments from the housebuilders to put a stop to their anti-competitive practices.

The claim will be filed in Q1 2026 in the Competition Appeal Tribunal, the UK’s specialist competition court. The claim has secured litigation funding from Burford Capital, the leading global finance and asset management firm focused on law.

Mark McLaren is a consumer champion who has dedicated a large part of his career to fighting for consumers, across a wide range of sectors including housing.  

Mark spent nine years working for The Consumers’ Association, more commonly known as Which?. Whilst there, he worked on the successful campaign to require estate, managing and letting agents to join a redress scheme, as well as on reforms to the home buying process and leasehold reform.

UK’s Competition Appeal Tribunal greenlights multi-billion pound collective action against Amazon over anticompetitive conduct targeting third-party sellers

LONDON, UK. 28 November 2025

The UK Competition Appeal Tribunal (“CAT”) has approved a multibillion-pound collective action against Amazon to proceed to trial.

judgment handed down on  24 July 2025 by the CAT confirmed that an “opt out” collective proceedings claim against Amazon can move ahead, paving the way for over 200,000 third-party sellers to claim compensation.

The claim, which currently stands in excess of £2.7bn against Amazon, sees the online retail platform accused of engaging in anticompetitive conduct.

Amazon’s market dominance and anticompetitive practices 

The claim, brought by Andreas Stephan, Professor of Competition Law at the University of East Anglia, focuses on multiple anti-competitive practices by Amazon that have harmed UK third-party sellers with “professional” selling accounts on Amazon. Any UK domiciled third-party seller that used a professional selling account to sell products on the UK version of the Amazon marketplace between June 2018 and June 2024 will be automatically part of the claim, unless they choose to opt out. 

Professor Stephan claims that Amazon has abused its dominant position in the market for the supply of e-commerce marketplace services to third-party sellers to reach customers in the UK by engaging in abusive behaviour that:

  • unfairly advantages its own retail products, harming third-party sellers;
  • unfairly advantages Amazon Retail offers when selecting which offers are displayed in the “Buy Box”;
  • unfairly advantages its own logistics/fulfilment arm (“Fulfilment by Amazon” or “FBA”), harming other logistics/fulfilment providers, and in turn, third-party sellers; 
  • unfairly conditions access to Amazon Prime on the use of FBA; and
  • distorts inter-platform competition by making it harder for third-party sellers to sell cheaper on other platforms. 

As a result of these abuses, says Professor Stephan, third-party sellers have lost sales, faced increased costs and paid higher fees to Amazon for its services than they would have under normal conditions of competition. 

The CAT has now made a collective proceedings order, confirming its decision to certify the claim, authorising Professor Stephan to act as the class representative and permitting the claim to proceed to trial.

Professor Stephan commented: “Recognition of our case by the Tribunal is an important first step in compensating the thousands of UK Amazon sellers who have lost revenues because of the tech giant’s unfair practices.”

Professor Stephan’s claim is backed by a legal team composed of competition litigation and digital markets specialists Geradin Partners, Kieron Beal KC (Blackstone Chambers), Daniel Carall-Green, Hannah Bernstein, and Christopher Monaghan (Fountain Court Chambers). Professor Stephan is also supported by a strong team of economists led by Dr George Houpis of Frontier Economics whose preliminary expert report was praised by the Tribunal as “comprehensive and very detailed”.

Geradin Partners represents LitFin in a second Google Shopping damages claim against Google in the Netherlands

This week, LitFin, supported by Geradin Partners, filed a second damages claim against Google in the Netherlands on behalf of a second group of six comparison shopping services who have suffered severe harm as a result of Google’s abusive conduct. In this case, LitFin maintains the position that Google – in spite of the Commission’s clear obligations in the Google Shopping decision to cease its abusive behaviour – continued to abuse its dominant position in search after 2017. This case follows the first claim that was filed to the Amsterdam District Court in April 2025 by LitFin on behalf of a first group of five comparison shopping services. 

As in the first claim, Geradin Partners serves as the lead competition law counsel, working in close cooperation with local litigation firm Stek Advocaten and with the support of independent economics consultancy Charles River Associates.

Geradin Partners continues its rapid expansion in Europe with its launch in Germany, as well as the addition of multiple partners, senior counsel, counsel and associates across its office network, increasing the total number of the firm’s specialist competition lawyers to over 50, including 17 partners.
