Geradin Partners represents class representative Dr Sean Ennis in successful certification of Apple App Store claim

The Competition Appeal Tribunal (CAT) has certified Dr Sean Ennis’ application for a collective proceedings order in his action on behalf of UK-domiciled app developers against Apple. This case is the second Geradin Partners collective action to receive CAT certification this year (the publisher ad tech case against Google was certified in June 2024), underscoring the firm’s growing influence in high-stakes competition litigation. 

Dr Ennis’ claim, which was filed in July 2023 on behalf of over 13,000 UK-domiciled iOS app developers, alleges that Apple has a dominant position in the market for iOS app distribution and has abused its dominance by charging prices (in the form of the commission charged on purchases of apps or purchases of additional content or subscriptions within those apps) which are excessive and unfair in their own right and/or unfair and abusive as a system of pricing.

In today’s judgment, the CAT unanimously dismissed Apple’s arguments against certification. Additionally, the CAT was satisfied that Dr Ennis is a suitable person to act as Class Representative owing to his relevant professional experience and the detailed litigation plan that he has in place to manage the litigation proceedings.

The CAT’s decision to certify the case is a significant step toward trial bringing Dr Ennis one step closer to holding Apple accountable for its alleged anti-competitive behaviour.

Daniel obtained his PhD from Leiden University, where he is an assistant Professor of law, on the anti-competitive aspects of online platforms and the interaction between such platforms and EU competition law.  He has published highly-cited articles, notably on the application of abuse of dominance law on app stores, on the SSNIP test and zero pricing strategies, and on the application of 102 TFEU on multisided online platforms.

After opening offices in Brussels in 2015, London in 2021, and Amsterdam in 2023, Geradin Partners continues its European expansion with the launch today of its Paris office with the hires of former EU official and competition litigator Marc Barennes and his team. 

Founding partner, Damien Geradin comments:

Marc Barennes is a competition litigator with 20-plus years of experience. With over 15 years at the European Commission and the Court of Justice of the European Union, he brings unique expertise in competition law. During his time with European institutions, he was directly involved in more than 350 cases, including more than 70 of the most complex and high-profile European cartel, abuse of dominance, merger and State aid cases. Before joining Geradin Partners, Marc also gained experience over the past five years of damages actions through his role as Executive Director of a leading claim aggregator, and co-founding partner of the first French claimant firm specialized in class actions. Marc has also been a Lecturer at French School of Law, Sciences Po Paris since 2014 and has been a non-governmental advisor to the European Commission and/or the French and Luxembourgish competition authorities for the International Competition Network (ICN) since 2012. He is a member of both the Paris and New York bars.

Marc Barennes apporte une expertise unique en droit de la concurrence. Geradin Partners act in win over Apple jurisdiction challenge

Geradin Partners is pleased to announce that Dr Sean Ennis, successfully defended Apple’s applications for a partial strike out of his claim that Apple breached competition law by charging UK-domiciled app developers an excessive and unfair “commission” – typically 30% –  for transactions made through the App Store. On 25 July 2023, Dr Ennis filed an application in the Competition Appeal Tribunal (the “Tribunal”) on behalf of a proposed class of UK-domiciled app developers under the UK’s opt-out collective proceedings regime for breaches of competition law.

Apple challenged the Tribunal’s jurisdiction to hear part of the case related to commission charged on transactions effected via the Non-UK App Store Storefronts, bringing the following applications:

1.For an order that the Tribunal lacks, or alternatively declines, jurisdiction over the proposed opt-out collective proceedings against Apple insofar as they concern commission charged on transactions effected via the Non-UK Storefronts;

2.For an order striking-out ,alternatively entering reverse summary judgment upon, the proposed opt-out collective proceedings against Apple’s UK entitled in respect of commission on transactions taking place through Non-EU Storefronts. That is on the grounds that the conduct complained of could not amount to a breach of Article 102 Treaty of the Functioning of the European Union (as retained in the UK following Brexit) (“TFEU”) and/or section 18 of the UK’s Competition Act 1998.

3.For a variation of the order permitting Dr Ennis to serve relevant documents on the Non-UK Proposed Defendants by an alternative method of service and at an alternative place.

      The Tribunal found that that Dr Ennis has a realistic prospect of successfully establishing that the claim is governed by UK law and of establishing that Apple’s conduct falls within the territorial scope of Article 102 TFEU and/or section 18 of the Competition Act 1998. This includes transactions effected via Non-UK App Storefronts because these are either: (i) implemented in the EU/UK or (ii) foreseeable that it would have an immediate and substantial effect in the EU/UK.

      This case sets an important precedent for UK business users when establishing jurisdiction of the Tribunal to hear claims for damages against globally operating platforms like the App Store. The Tribunal can be the appropriate forum for such cases, including where it concerns sales made by those UK business users to consumers based abroad.

      Geradin Partners instructed on EUR 2.1 billion ad tech claim against Google on behalf of over 30 European media companies

      Over 30 European news media companies today filed a EUR 2.1 billion damages claim against Google in relation to its practices in ad tech. Google’s conduct was found to be an abuse of dominance by the French competition authority in June 2021. Following this, the European Commission opened proceedings against Google and issued a statement of objections in June 2023. Now, more than 30 large and medium-sized European news media companies are suing Google for damages suffered as a result of Google’s abuses. The case was filed in the District Court of Amsterdam on 28 February 2024. 

      Geradin Partners, with offices in Brussels, Amsterdam and London, has been instructed to represent the claimants, alongside Dutch litigation firm Stek and economist consultancy Charles River Associates. The case is funded by Harbour. Geradin Partners previously acted for the complainants in the French investigation, as well as for the European Publishers Council in its complaint to the European Commission. It is also one of three solicitor firms instructed in the opt-out class action brought against Google in the UK relating to the same ad tech practices.
